Terms of Service — FlashCards Fit

1. Acceptance of Terms

By accessing or using FlashCards Fit ("flashcards.fit"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the service.

2. Description of Service

FlashCards Fit is a web-based flashcard platform that allows users to create, study, and manage flashcard decks. The service offers a free tier and a paid Pro subscription with additional AI-powered features including flashcard generation, audio pronunciation, and AI-generated images.

3. Eligibility

You must be at least 13 years of age to use this service. By using FlashCards Fit, you represent and warrant that you meet this age requirement.

4. Accounts

You are responsible for maintaining the security of your account and password. FlashCards Fit uses Clerk for authentication, including Google OAuth sign-in. You are responsible for all activity that occurs under your account.

5. Pro Subscription

The Pro plan is billed monthly at $9.99/month via PayPal. You may cancel your subscription at any time. Upon cancellation, you will retain access to Pro features until the end of your current billing period. No refunds are provided for partial months.

6. User Content

You retain ownership of any content you create on FlashCards Fit, including flashcard decks and cards. You are solely responsible for the content you create. We reserve the right to remove content that violates these terms or is otherwise objectionable.

7. Acceptable Use

You agree not to misuse the service, including but not limited to: attempting to gain unauthorized access, interfering with other users, uploading malicious content, or using the service for any illegal purpose.

8. Data Storage

Your data is stored on a self-hosted server located in the European Union. While we take reasonable measures to protect your data, we cannot guarantee absolute security. We are not liable for any loss of data.

9. Service Availability

FlashCards Fit is operated by an individual and provided on an "as is" basis. We do not guarantee uninterrupted availability. We reserve the right to modify or discontinue the service at any time with reasonable notice.

10. Limitation of Liability

To the maximum extent permitted by law, FlashCards Fit and its operator shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the service.

11. Changes to Terms

We reserve the right to update these terms at any time. Continued use of the service after changes constitutes acceptance of the new terms.
